What is commercial mediation?
Commercial mediation is a confidential, structured negotiation led by an independent mediator, whose job is to help parties in a dispute reach an agreement they control - rather than an outcome a court imposes. It is faster and dramatically cheaper than litigation, it is conducted on a without prejudice basis (what is said in the room cannot generally be used in court later), and it works: around nine in ten commercial mediations settle on the day or shortly after.
When is the right time to mediate?
Earlier than most parties think. The best time is when positions are still flexible: before proceedings are issued, before legal costs distort the commercial logic, and before the relationship is beyond repair. Mediation can still succeed mid-litigation, but every month of escalation narrows the space for a good outcome.
